This document details the Eltrex SRL practice regarding the commercial conditions applicable in the case of the domain https://www.eltrex.net (hereinafter referred to in short, generically, the Site) and its purpose is to inform users about this subject.

These „Terms and conditions” are assumed by the Company, but also by the visitors of the Site (by you).
So, the use of the Site by visitors, automatically implies acceptance of all the provisions below and the policies referred to (where the law does not require additional steps to be taken to express such agree), as well as assuming the obligation that they have the right and the free and full capacity to access the Site and to provide information to the Company.

Regarding the Company’s desire to create the necessary conditions for users to send requests of any kind, personal data are processed when a user sends an email to one of the two Eltrex addresses, referred to in point 1.

ALTHOUGH ELTREX MAKES ALL REASONABLE MEASURES REQUIRED BY APPLICABLE LAW TO PROTECT THE PERSONAL DATA OF SITE VISITORS, THE COMPANY WILL NOT BE ABLE TO ENSURE OR GUARANTEE THE SECURITY OF ANY KIND OF INFORMATION TRANSMITTED. SO, THE TRANSMISSION OF INFORMATION IN AN INADEQUATE ENVIRONMENT IS MADE AT THE OWN RISK OF THE SITE VISITOR.
When sending requests using Eltrex email addresses from the contact section, visitors undertake to submit to the Company real and valid data.
Also, by using the Site, each visitor assumes that he can perform the respective approach and can express his valid consent (where applicable), freely and without the need of prior approval from a third party, which have not been obtained by the visitor.
If the provided data will be changed, visitors have to communicate this aspect to the Company immediately, so that the Company to be able to respect its legal obligations and the contractual ones assumed (for example: the response to the request sent by the user).
THE STUDY OF THE TERMS AND CONDITIONS, THE PRIVACY AND DATA PROTECTION POLICY AND THE COOKIE POLICY, REPRESENTS A STEP TO BE TAKEN BY VISITORS EVERY TIME WHEN THE SITE IS ACCESSED AND BEFORE ANY RECORDING OR PROVIDING OF DATA IS MADE, BECAUSE THERE MAY BE CHANGES.
Eltrex has the right to change/update the content of the Site, including the policies referred to, at its own discretion at any time and for any reason (including, but not limited to, the occurrence of legislative or case law changes that may affect the consequences of what is published on the Site). Reviewing this policy in the future will be reported by changing the date of the „Last update” from the top.
However, if there are significant changes that could affect the rights and freedoms of visitors, informing them of those changes will be done by easily visible indications posted on the Site (pop-ups) or by sending e-mails to the addresses provided, if necessary. Such important changes will have effects for visitors within 15 days of the pop-up in question is displayed or sending the e-mail by the Company (the way the company will make the information will be decided by it, from case to case).
However, regardless of the size of the change, the responsibility for verifying the content of the Site belongs entirely to the user – to be up to date with the latest versions ((including the Terms and Conditions, as well as the Policies displayed). The site is in no way responsible for content provided by third parties (whether or not it is an advertising site) and how those third parties intend to respect their legal obligations.
Visitors are the only responsible for choosing, obtaining, configuring and maintaining the equipment used to access the Site.
So, Eltrex does not offer any guarantee regarding issues related to, among others: the compatibility of the Site with the hard and soft equipment used by visitors; the colors or clarity of images taken from the Site, the effects of using the Site (including but not limited to the generation of viruses), as well as the proper and trouble-free working of the Site. However, the Company’s liability regarding the processing of personal data is not excluded by this clause and it is not reduced below the minimum allowed by the specific legislation in force to this field.
There are not allowed: the insertion of references and links to the Site, copying/modifying/transmitting/ publishing/using in any way the information indicated in the content of the Site, without the express written pre-approval of the Company.
In addition, visitors declare that they will only use the Site for legal activities and that do not infringe the rights of third parties. Also, they will not submit documents or requests pretending to be someone else or on another person’s behalf and they will not take steps that could affect the integrity of the Site or of the data contained in it (including but not limited to viruses, deletion or modification of information, electronic abuse, fraud, unauthorized use of personal data).
Non-compliance with the obligations in this document, as well as any other obligation laid down by law for websites visitors, will lead to their liability and the obligation to cover the damage caused by the culpable act.
This Site is secured by competitive systems. However, the Site, like most websites and applications on the Internet, are not completely free of vulnerabilities.
As a result, information submitted by visitors using the Site, may be exposed to privacy and security risks, which exceed the direct control of the Company (such as: sending unrequested spam messages, virusing of used equipment, IP address theft, unauthorised e-mail access) and for which Eltrex assumes no responsibility, while trying to avoid such unpleasant events.
The privacy of the Site visitors’ data is an important issue for the Company.
Our Privacy and Data Protection Policy is an integral part of these Terms and Conditions and can be accessed by you at any time.
Rights and Obligations of Parties (visitors and the Company), as well as all the legal effects that the activity of the Site produces, will be interpreted and governed by Romanian law.
All disputes will be resolved before the ordinary courts at the headquarters of the company.
None of the parties will be liable for non-performance of the assumed obligations, if such complete or partial failure to perform in time and/or properly, is caused by a force majeure event. The parties agree that such an event could be virusing of the Website or the IT platform behind it for reasons not linked to an action of the Company, a certificate issued by an authority in this sense it’s not required, but informing (via e-mail or through the Site) the affected persons. A far as the applicable law to the personal data requires other obligations in such cases, the company will comply with these legal requirements.
This policy applies to the Company and to the visitors of the Site.
